HOSPITEN GESTIÓN A.I.E. (hereinafter, HOSPITEN), in accordance with EU Regulation 2016/679 on Data Protection and other current regulations on Personal Data Protection, informs the users of the website www.hospiten.com (hereinafter, the Site) and of the APP it owns, of the Privacy and Data Protection Policy it will apply to the processing of the personal data that the User voluntarily provides when accessing its website and downloading the aforementioned APP to their devices.
For the purposes of this Privacy and Data Protection Policy, references to the Site, Page or Website shall also include erhospiten.com, an official website linked to www.hospiten.com and used for Grupo Hospiten advertising campaigns and to provide information about medical services offered by its hospitals in Mexico.
erhospiten.com is a website built for Grupo Hospiten's advertising campaigns and is part of Grupo Hospiten (hospiten.com).
What personal data do we collect and what do we use it for?
Data collected directly: by voluntarily filling out the contact form, sending your CV, interacting in our Social Networks, subscribing to our Newsletter, responding to surveys and registering for the services offered by the HOSPITEN APP.
Data collected indirectly through the use of cookies: for statistics, to analyze the use made of our Page/APP and to provide value-added services such as the location map of our offices.

Data Processor
HOSPITEN GESTIÓN, A.I.E. acts as a service provider, in charge of data processing, for the integral management of the Entities that make up the HOSPITEN GROUP. These Entities are identified and can be consulted in the Legal Notice.
Purpose of treatment
- Management of Online Appointment requests.
- Attending the queries of the Users who contact us through the Contact sections.
- To process the inscription in courses and events.
- Manage subscriptions to the newsletter or bulletins.
- Manage the Hospiten Group job offers through the "Work with us" section.
- Sending information related to the provision of Hospiten healthcare services.
- Cookies: to maintain the registered user login, the validity of the shopping cart, provide statistics associated with the use of the Page/APP, the location of our offices and anti-spam systems.
Additional purposes: Sending offers and promotions, by postal and electronic means, related to the services offered by HOSPITEN in its healthcare services sector, with the possibility of obtaining profiles and segmentation work, based on the information available in order to personalize treatment according to your characteristics and/or needs.
Basis of legitimization
The legal basis for the processing is the consent given by the User by ticking, where appropriate, the corresponding acceptance box of the Privacy Policy in each case and by validating your email account in the registration forms, as well as the linking in person at the centers of the User of the APP to the Medical History of the user.
The establishment of a contractual relationship for the provision of healthcare services according to the service requested.
The fulfillment of legal obligations of the person in charge at the time of providing the health services requested.
The legitimate interest of the Responsible Parties in keeping you informed in relation to products or services of the healthcare activity you receive.
Recipients of assignments and international transfers
Your data may be communicated to other Entities that form part of the HOSPITEN Group, whose composition at any given time can be consulted on their web page www.hospiten.com, which market and provide services in the same sector of activity.
The Controller and in general the entities of the Group make use of MICROSOFT CORPORATION's "Business Online Services" through the use of tools such as Office 365, Azure, their use constituting an international transfer of personal data of European citizens to the USA, authorized through the Commission's Adequacy Decision of 10 July 2023, EU-USA Data Privacy Framework.
The Page/App has enabled Google Analytics services provided by Google LLC, an entity located in the USA and adhered to the Commission Adequacy Decision of July 10, 2023, EU-USA Data Privacy Framework.
Exercise of rights
The interested party may exercise their rights of access, rectification, suppression, portability and limitation or opposition, by writing to HOSPITEN GESTION A.I.E. with address at Plaza 25 de julio, Apartado de correos 10681, 38004 Santa Cruz de Tenerife. Spain. Or by sending an e-mail to: protecciondedatos@hospiten.com, duly proving your identity.
The interested parties have the right to withdraw the consent given through the different forms of the Page/APP.
The interested parties have the right to complain to the Control Authority (Spanish Data Protection Agency: www.aepd.es).

In order to comply with the purposes set forth in this Privacy Notice, we will not collect or process sensitive data.

Hospiten will use your personal data to contact you and follow up on your comments and/or suggestions; contact you to inform you about promotions and/or offers related to our services; prepare studies and statistical reports related to your consumption habits; contact you to conduct satisfaction surveys; contact you to invite you to events; register you for events and courses, and register you for our newsletter.

Data transfer
Hospiten, in order to comply with the purposes set forth in this Privacy Notice, may transfer your personal data to both domestic and foreign entities, without requiring your consent, in the following cases:
- To competent authorities in the cases legally provided for.
- To independent third parties that provide a service that is necessary to comply with the purposes set forth in this Privacy Notice.
- To those companies that are part of the Hospiten corporate group, that is, to our controlling company, as well as Hospiten subsidiaries and affiliates for the proper provision of our service.

In order to fulfil the purposes set out in this Notice, Hospiten will process identification data, contact data, location data, data on physical characteristics, financial data and asset-related personal data.
We also inform you that, in order to fulfil the purposes of the services covered by this notice, sensitive health data will be processed. We undertake that such data will be processed under strict security measures, always guaranteeing its confidentiality.
Primary purposes of the treatment
- Provision of medical and hospital services, including without limitation hospitalization, surgery, diagnostic studies, nursing care, pharmacy services, blood bank services, hemodialysis, oncology treatments, laboratory analysis, radiology and imaging, pathology studies and analysis, therapy, rehabilitation, diet and nutrition, and other purposes related to health services.
- Carrying out all activities related to providing medical care to the patient.
- Keeping records of patients admitted to Hospiten.
- Carrying out the procedures necessary for billing and collection of the services you have contracted with Hospiten.
- Handling complaints and/or claims related to the care received.
- Managing and handling online medical consultations or those conducted through any other technological communication channel agreed with the patient.
