In compliance with the provisions of Law 34/2002, of July 11, 2002 on Information Society Services and Electronic Commerce, we hereby inform you that this web site regulates the use of the web page www.hospiten.com and the so-called HOSPITEN APP (hereinafter the Site/APP), owned by HOSPITEN GESTIÓN A.I.E. (hereinafter, HOSPITEN), with registered address at Rambla de Santa Cruz, nº 115. 38001 Santa Cruz de Tenerife. Spain. Tax ID No. V38580064; registered in the Mercantile Register of Tenerife, Volume 1994, Folio 156, first entry, page TF-23010 and with e-mail address hospiten@hospiten.com.

For the purposes of this Legal Notice, references to the Site or APP shall also include erhospiten.com, an official website linked to www.hospiten.com and used for Grupo Hospiten advertising campaigns and to provide information about medical services offered by its hospitals in Mexico.

The entities that make up the Hospiten Group (hereinafter, the GROUP) and that manage their information and services through this page are the following:

The services offered through the Web Site are exclusively for Spain, Dominican Republic, Mexico, Jamaica and Panama.

The owner of the Page/APP, HOSPITEN GESTIÓN A.I.E., is permanently established throughout the Spanish territory and its administrative management is centralized at the above address.

In order to use the Page/APP, the user is required to expressly accept each and every one of the clauses indicated in this Legal Notice, as well as each of the warnings or specific clauses established for the contracting of certain services, products or use of areas of the Page/APP.

In case of not accepting the clauses established in this Legal Notice, the user must refrain from accessing and/or using the services and/or contents made available on the Page, or uninstall the APPs from their devices and abandon the use of the same.

Use of the page / App

The user undertakes not to use the Page/APP to carry out activities contrary to the law, morality, public order and, in general, to use it in accordance with the conditions set forth in this Legal Notice. Likewise, he/she undertakes not to carry out advertising or commercial exploitation activities by sending messages using a false identity.

HOSPITEN acts exclusively as the party responsible for the Page/APP, in its capacity as the provider of a service to customers and the general public on general information about HOSPITEN and the services offered by the Companies that make up the GROUP, and is not responsible for the contents that, in contravention of these general conditions, the users may send or publish, the user being the only party responsible for the truthfulness and legality of the same.

For the purposes of the official presentation of claims, the user should contact the Entities of the GROUP where he/she has received the services, which have at the disposal of their clients the forms enabled for this purpose, which may be requested through the Patient Attention Service.

All the information received on this Page/APP, such as comments, suggestions or ideas, will be considered given to HOSPITEN free of charge. Please do not send information that cannot be treated in this way.

The service being used by the user may be interrupted and the relationship with the user may be immediately terminated if a use of the Page/APP, or of any of the services offered therein, is detected that may be considered contrary to what is expressed in this Legal Notice.

Intellectual and industrial property

This entire Site and the content developed in the HOSPITEN APP: text, images, trademarks, graphics, logos, buttons, software files, color combinations, as well as the structure, selection, arrangement and presentation of its contents, are protected by Intellectual and Industrial Property laws, and its reproduction, distribution, public communication and transformation is forbidden, except for personal and private use.

The Page/APP may include links to third party sites. The sites belonging to third parties have not been reviewed and are not subject to controls by HOSPITEN. In any case, HOSPITEN cannot be held responsible for the contents of these web sites nor for the measures adopted concerning your privacy or the treatment of your personal data.

HOSPITEN recommends that you carefully read the conditions of use and the privacy policy of these sites.

If you are interested in activating a link to any of HOSPITEN's pages, you must inform HOSPITEN, obtaining express consent to create the link. HOSPITEN reserves the right to oppose the activation of links to its website or APP.

Minors

Access to and use of the Web Site by minors or unauthorized minors is prohibited. Minors must request and obtain permission from their parents, guardian or legal representative before being able to access the contents incorporated in the Page/APP. In any case, the condition of Client can never be held by a minor, unless he/she acts through a legal representative. HOSPITEN reminds that it will be the responsibility of the parents or guardians to exercise adequate control over the activity of the children or minors in their care.

Likewise, HOSPITEN informs of the possibility of installing some of the tools to control the use of the Internet in order to prevent access, as well as to avoid sending personal data without the prior authorization of their parents or guardians. Under no circumstances will the installation of these tools be required of HOSPITEN.

With respect to the services offered in the APP, minors from 14 years of age can register and access the APP; the rest of the minors cannot register or use the APP unless they are legally represented by an accredited legal representative before the Center.

The use of the APP by a minor will be covered by the current legislation on health care and medical records management, and always respecting the rights and freedoms of minors.

Disabled persons must be legally represented in the APP.

Partial nullity

In the event that any term included in this Legal Notice is declared null and void, the other conditions shall remain in force and shall be interpreted taking into account the will of the parties and the purpose of the same.

The non-exercise by HOSPITEN of any right derived from these Terms will not be construed as a waiver of such right, unless HOSPITEN expressly waives it in writing or the statute of limitations of the action that may be applicable in each case.

Modification of general conditions

HOSPITEN reserves the right to modify, at any time and without prior notice, the presentation and configuration of the Site/APP, as well as the General Conditions and Privacy Policy. The Users will always have these General Conditions at their disposal in a visible place, freely accessible for any queries they may wish to make.

Users must read this Legal Notice carefully each time they access the Page/APP. In any case, the acceptance of the expressed terms will be a previous and indispensable step to the contracting of any service available through the Page.

Fuero

El presente Aviso Legal se encuentra redactado en castellano y sometido a la legislación española vigente. Para cualquier tipo de controversia derivada de la utilización de los servicios ofrecidos o de los contenidos propios de la Página/APP las partes, con la aceptación del clausulado establecido en el presente Aviso Legal, se someterán a los Tribunales y Juzgados competentes de Santa Cruz de Tenerife (Islas Canarias).
